As an electronic money institution, Belmoney offers a 14-day cooling-off period for consumers. Belmoney may terminate with two months' notice or immediately in cases of serious violation, fraud risk, KYC non-compliance, prolonged inactivity, or regulatory obligations. Any reproduction, distribution, modification, reverse engineering, decompilation, or other unauthorized exploitation is strictly prohibited and may constitute a violation of Belgian and EU intellectual property laws, potentially resulting in civil or criminal prosecution.
12. Disclaimers
The Service is provided "as is" and "as available". Belmoney does not guarantee uninterrupted or error-free operation. Belmoney assumes no responsibility for network failures, telecommunications operator failures, Internet interruptions, equipment failures, or any other circumstance beyond its control. Belmoney disclaims any liability for the actions or omissions of third-party distribution partners, banks, or agents in CEMAC countries after fund release. Content provided is for informational purposes only; Belmoney does not guarantee absolute accuracy, completeness, or timeliness.
13. Customer Liability for Losses
The User is liable for all losses resulting from: Terms violations, false or misleading information, failure to maintain credential confidentiality, sharing credentials, or gross negligence. In accordance with Article 74 PSD2, the User may be held liable up to €50 for unauthorized use before notification, except for fraud or intentional negligence (unlimited liability). The User agrees to indemnify Belmoney against any claim, loss, liability, cost, or expense (including legal fees) arising from their breach, negligence, fraud, misuse, or violation of third-party rights.
14. Belmoney Liability
Belmoney's liability is governed by PSD2 and Belgian law. For unauthorized payment operations, Articles 73-74 PSD2 apply. For non-executed or incorrectly executed operations, Article 89 PSD2 attributes liability (payer provider for transmission/debit; beneficiary provider for account credit). To the extent permitted by law, Belmoney's total liability for any claim relating to the Terms must not exceed the Transaction amount concerned or €500, whichever is higher. Belmoney excludes liability for indirect, incidental, consequential, special, or punitive damages (including loss of profits, data, or reputation), whether contractual, tortious, or otherwise, even if Belmoney has been informed of their possibility. Nothing in the Terms limits liability for death/personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.
15. Dispute Resolution and Applicable Law
Complaints must first be addressed to Belmoney's customer service (compliance@bel.money). In accordance with Article 101 PSD2, Belmoney will acknowledge receipt within a reasonable time and provide a final response within 15 Business Days (or up to 35 days in exceptional circumstances, with explanation). If unresolved, EU consumers may access out-of-court dispute resolution procedures in accordance with the Alternative Dispute Resolution (ADR) Directive, including the Belgian Consumer Mediation Service (https://consommateurs.be) and the EU Online Dispute Resolution platform (https://ec.europa.eu/consumers/odr). These Terms are governed by and interpreted in accordance with Belgian law. Subject to mandatory EU consumer protection rights, the courts of Brussels, Belgium, have exclusive jurisdiction to settle any dispute arising from the Terms or Service.

17. Service and Agreement Modifications
Belmoney may modify the Terms or Service for legal, regulatory, security, technical, or commercial reasons. Material modifications will be notified at least two months before the proposed effective date in accordance with Article 54 PSD2. If the User does not accept the modifications, they may terminate immediately and free of charge before the effective date. Continued use after the effective date constitutes acceptance. Non-material modifications may be made without notice but will be communicated via the Application.
18. Other Terms
If any provision of the Terms is deemed invalid, illegal, or unenforceable, the other provisions remain in force. Belmoney's failure to exercise a right does not constitute a waiver. The User's rights and obligations under the Terms cannot be assigned without Belmoney's prior written consent. Belmoney may assign/transfer the Terms to affiliates or successors with notification. Electronic records maintained by Belmoney constitute proof, except contrary evidence. The French version of the Terms prevails; translations are provided for reference.
